Terms of Service

Important — Please read before using

Guardian is not a medical application and is not a covered entity or business associate under HIPAA. It does not collect, store, or transmit Protected Health Information (PHI) as defined under 45 C.F.R. §160.103, and it must not be used for any clinical, diagnostic, or medical purpose. Guardian is currently in beta. These terms may be updated before general availability.

1. Acceptance of terms

By accessing or using Guardian ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users, including athletes, coaches, athletic trainers, directors, and administrators.

2. Description of service

Guardian is an athlete wellness monitoring platform designed for use by schools and sports programs. It allows athletes to submit daily self-reported wellness check-ins and enables authorized staff — coaches, athletic trainers, and directors — to monitor athlete readiness, track wellness trends, and manage program rosters.

Guardian is an athletic performance and readiness tool, not a healthcare service. It is not a medical device as defined under 21 U.S.C. §321(h). It does not diagnose, treat, cure, mitigate, or prevent any disease or medical condition. It does not provide medical advice, clinical assessments, or professional health opinions of any kind. Nothing in the Platform constitutes or should be construed as medical advice.

Use of Guardian does not create a physician-patient, therapist-client, or any other professional healthcare relationship between Synergy Sports and Rehab and any user.

3. Not a HIPAA-covered service

Guardian is not subject to the Health Insurance Portability and Accountability Act (HIPAA). Synergy Sports and Rehab is not a covered entity (health plan, healthcare clearinghouse, or healthcare provider) as defined under 45 C.F.R. §160.103, and does not act as a business associate of any covered entity in connection with this Platform.

The data collected by Guardian — self-reported wellness check-in responses, readiness scores, and related athletic data — does not constitute Protected Health Information (PHI) under HIPAA. This data is not created, received, maintained, or transmitted in connection with the provision of healthcare, health plan administration, or healthcare payment operations.

You must not enter PHI into Guardian. Do not use the Platform to store, transmit, or process medical records, diagnoses, treatment plans, prescription information, insurance information, or any other information that qualifies as PHI under HIPAA or as sensitive health data under applicable state law. Guardian is not designed or secured to handle such information and provides no HIPAA-compliant safeguards for it.

4. Beta software disclaimer

Guardian is provided as beta software for evaluation purposes only. During the beta period:

  • Features, workflows, and data structures may change without notice.
  • The Platform may experience downtime, data loss, or unexpected behavior.
  • Wellness scores and trend data must not be used to make clinical, medical, or return-to-play decisions without independent professional assessment.
  • Synergy Sports and Rehab makes no guarantees of uptime, accuracy, or fitness for any particular purpose during the beta period.

5. Accounts and access

Athlete accounts are created by authorized school staff (athletic trainers, directors, or administrators) — athletes do not self-register. By accepting an account, you agree to use it only for its intended purpose within your school program.

  • You are responsible for keeping your login credentials confidential.
  • You must not share your account or allow others to access the Platform under your credentials.
  • Access is role-based. You may only view and act on data your role permits. Attempting to access data outside your role is a violation of these terms.
  • Administrators may modify, suspend, or delete any account at any time.

6. Acceptable use

You agree to use Guardian only for its intended purpose: supporting athlete wellness monitoring within your school's sports program. You must not:

  • Enter, upload, or transmit Protected Health Information (PHI), medical records, diagnoses, prescriptions, or insurance data of any kind.
  • Use the Platform as a substitute for professional medical assessment, diagnosis, or treatment.
  • Rely on wellness scores or alerts as the sole or primary basis for any health-related decision.
  • Enter false, misleading, or fabricated wellness data.
  • Attempt to circumvent role-based access controls or access another user's data without authorization.
  • Use the Platform for commercial purposes unrelated to your school program.
  • Attempt to reverse-engineer, scrape, or extract data from the Platform in bulk.

7. Wellness data and scores — not medical assessments

Wellness scores generated by Guardian are calculated solely from athlete self-reported responses. They are readiness indicators, not medical assessments. These scores:

  • Are not a medical diagnosis, clinical evaluation, or professional health opinion.
  • Are not a substitute for evaluation by a licensed healthcare provider.
  • Should not be the sole basis for return-to-play, rest, medical referral, or treatment decisions.
  • Reflect only what an athlete self-reported at the time of submission; they may not accurately represent the athlete's true physical or mental condition.
  • Do not account for medical history, underlying conditions, or information not entered into the Platform.

Authorized staff are solely responsible for how they act on wellness data. Any decision to rest, return, refer, or treat an athlete must be based on independent professional judgment — not on Guardian scores alone.

8. Student athletes and minors

Guardian is used in school athletic programs and may be accessed by student athletes who are minors. Accounts for minor athletes are created and managed by authorized school staff. By creating an account for a minor athlete, the responsible staff member represents that they have appropriate authority to do so under their school's policies and applicable law, including but not limited to the Family Educational Rights and Privacy Act (FERPA).

9. Privacy

Your use of Guardian is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Platform, you agree to the collection and use of information as described there.

10. Data deletion

When an account is deleted by an administrator, all associated data — including wellness submissions, pain reports, and headache assessments — is permanently and irreversibly removed. There is no recovery process once deletion is complete.

11. Limitation of liability

To the maximum extent permitted by applicable law, Synergy Sports and Rehab and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, the Platform — including but not limited to any health, safety, or medical outcome resulting from decisions made based on wellness scores or data presented in the app.

In no event shall Synergy Sports and Rehab be liable for any loss or injury resulting from reliance on Guardian as a medical tool, clinical decision support system, or substitute for professional healthcare services. The Platform is provided "as is" during the beta period without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Changes to these terms

We may update these Terms of Service as the Platform evolves. We will notify users of material changes before they take effect. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms.
